CyviZen holds the view that the only thing man is capable of making is art
The intent of this agreement is to ensure that you, are able to 1) use &/or assist with research of prototype technology and 2) you can own your own data in all situations, circumstance, and 3) that CyviZen as an entity and extended community is held blameless for what that data or prototype technologies may be. This intent is codified as 'Responsibility is Power'
CyviZen is architected from the perspective that perceptive awareness of (wo)man is unique, maintains a cultural identity via a community and may interface with others from separate communities as part of their existence.
CyviZen technology designed to be offline-first, quantum decryption resistant, distributed and ephemeral
CyviZen is unable to access or build capability to access your data
Responsibility
CyviZen tagline is Responsibility is Power; All who use any part of CyviZen Technology or Ecosystem for any purpose accept responsibility for their actions. CyviZen is unable to grant technological power to any whom do not accept responsibility
Senses, Apps, Artefacts within CyviZen Ecosystem may require additional agreements &/or contracts to clarify responsibility and/or power. DeniZen are through their freedom able to accept said agreements &/or contracts provided such do not conflict with Law, International Treaties (e.g. International Covenant on Civil and Political Rights (ICCPR) Article 16, 18, 19, 23, non-exhaustive example)
DeniZen may contact CyviZen at any time for clarification, on responsibility on any situation
Access
CyviZen technology, inclusive of any Sense, Shell; using, augmenting, or leveraging CyviZen technology is only accessible to those whom are:
- Enthusiasts - those whom wish to gain skill, knowledge & understand a specific thing (CyviZen)
- Professionals - those whom may link their livelihood to what they are an Enthusiast in
- Specialists - those whom wield with power skills gained from their Enthusiasm
For simplicity CyviZen refers to those whom agree to accept their FETE (From Enthusiast To Enthusiast); this contract as DeniZen(s)
To clarify, CyviZen technology is not available to any who are not DeniZen(s). That being said, DeniZen(s) are at liberty to share CyviZen technology with those whom may wish to become a DeniZen in time; provided sharing of CyviZen Technology does not 1) leave the shell, 2) expose trade secrets, 3) divulge information restricted to DeniZen to non-DeniZen or 4) risk harm to a non-DeniZen
Non (wo)man
- CyviZen technology is only suitable for those of mankind whom choose to become DeniZens
- CyviZen technology is not suitable for servers, entities, artificial intelligence et al.
- CyviCo is the only access-way for entities into CyviZen and entities abilities are strictly regulated
Cy
Cy is CyviZens deed & settlement based infrastructure token, it is consumed in provision of DeniZen, CyviZen & Related technologies
- Cy requires deeds & settlements
- Cy is not accessible to any outside of CyviZen Ecosystem
- Cy is capable of operation at a universe scale or offline (3 people in a field)
- 1 Cy = 1/100 Silver Troy Ounce (tOz);
- Cy is backed by Silver is discussed as weight or a unit itself, it is appropriate to say "i will settle that in weight of 1000 Cy"
- when held meets the requirements of property
- when held is the receipt and redemption of the metal should conditions be met
- Cy has no taxes or fees; 1 Cy sent = 1 Cy received
- can be shredded by request of the DeniZen holding the Cy
- shredding cannot be undone
- shredded Cy is unrecoverable
- Cy is stored in a coffer;
- only a Envoy/CTC/App/(CyviCo Entity) may control a coffer
- coffers hold no link to their controller
- coffers may be shredded
- shredded coffers can never be restored
- coffers must have no active retainers to be shredded
- shredded coffers grant Autarky control over coffer ensuring you have continued access to settlement record of coffer
- Autarky can be granted assistive control of coffer for retainer (scheduled settlements)
- Autarky granted control is non-revokable
- Cy moves between coffers via settlement;
- details of settlement are only visible to the coffers involved in settlement
- agreements, inclusive of artefacts or licensing may be attached to a settlement
- note field of 110 characters is available, note field might be disclosed
- Autarky Network Contracts are available for regulation of data sharing per agreement
- Autarky coffers may use Retainers for scheduled settlements
- Insufficient Cy in coffer for retainer to settle is a debt;
- Cy debt is debt as recognised as debt in Court, international, legal framework, private or otherwise
- CyviZen in good faith grants Autarky style coffers a negative capability where a retainer requests settlement beyond weight of Cy available in coffer
- Settlements triggered by retainer that lack Cy are pending, and do not settle until sufficient Cy is available in coffer; hence the debt;
- Artefacts involved in settlements or retainers may be unavailable during debt of settlement
- Agreement as specified in settlement & Autarky Network Contract will determine action in this situation
- Accumulated debt may result in CyviZen having to destroy infrastructure reserved for the DeniZen
- DeniZen data will be lost
- DeniZen might be banned from CyviZen Technology
Cost
- Grant of CyviZen DeniZen is not gratis, not libre and not free;
- CyviZen uses distributed technologies, ephemerally, where possible;
- provision of DeniZen, CyviZen & Related technologies comes at a cost; CyviZen requires this cost to be settled by DeniZen on a monthly basis
- 10 Cy per month settled via retainer
- Insufficient Cy in coffer for retainer to settle is a debt;
- Acceptance of FETE is commitment to ensuring sufficient Cy is available in Coffer
- DeniZen commits to this while any DeniZen data resides in CyviZen infrastructure irrespective of DeniZen use of CyviZen Technology
- Retainer may be cancelled by no longer wishing to have a DeniZen;
- CyviZen must be notified in writing of DeniZen deletion request
- CyviZen has no ability to recover deleted DeniZen or associated data
Intellectual Property
- CyviZen, CY, CYN, CyviCo, Cyvi[any alphanumeric following] are the Intellectual Property of CyviZen
- Apps may have their own Intellectual Property
- trade secret is the default Intellectual Property protection in CyviZen, not Copyright, authorship is traceable and provable via CyviZen technology.
- Data of any kind is classified as the creative work by the author by default see No License
- the creative work is able to be licensed as determined by the author
- an agreement/contract & settlement must be in place to transfer ownership
- due to trade secrets being default Intellectual Property protection in CyviZen, sharing of data with any other DeniZen or CyviCo entity is non-revokable unless such sharing is regulated via Autarky network contract
- CyviCo Entities are the author of the creative work
- A DeniZen while actively using a CyviCo profile does not and has no claim to the authorship or the creative works of the CyviCo Entity
- For Clarity, all data available on the CyviCo profile might be the creative work of the CyviCo Entity; all data available on the CyviCo profile is not the creative work of the DeniZen
- Availability of a CyviCo profile on a shell does not constitute a CyviCo claim of authorship to DeniZen data;
Theft of Intellectual Property or the creative work requires compensation of damages and/or may be viewed as a crime
Artefacts
- CyviZen Technology may bridge digital & physical realms
- Shells are approved by CyviZen and available via www.cyvizen.art
- Apps may bridge all realms, CyviZen does not monitor, approve or regulate artefacts;
Physical Seals
- Physical Technology (Shells) are shipped with a FETE seal
- breaking of the FETE seal is acceptance of this contract irrespective of if broken by you or another, or you have a DeniZen at time of breaking of seal
- FETE sealed technology is uniquely produced (similar to commissioned art), no two are the same as such consumer protection, refunds, warranty do not apply and are forfeit; to clarify you who broke the seal, or did use the shell (attempted or otherwise) state that you are an Enthusiast only and forfeit any and all rights under international treaty available to members of the General Public
Exchanges of Artefacts
- Settlements are required for Exchange of Artefacts
- Cy is required to be used for exchange of anything that uses CyviZen Technology directly or indirectly
- CyviZen offers no warranty implied or otherwise for exchanges of artefacts via apps within CyviZen Ecosystem
Sale of Technology
- Apps may provide artefacts in digital and/or physical form.
- Digital artefacts are required to be capable of being transferred;
- by default digital artefacts are non-transferable;
- mitigating circumstance might permit transfer of digital artefacts
- CyviEstate assists estate management; inclusive of digital assets to be inherited per wish
- Physical artefacts, where such artefact is a CyviZen shell requires notification to CyviZen of the new controlling DeniZen. Failure to do so may trigger security actions in CyviZen Operating System that may result in loss of data
- Physical artefacts acquired via App are per the agreement of settlement

CyviCo
- CyviCo is an augmentation of CyviZen for commercial requirements
- Apps that wish to use or leverage CyviZen technology are listed on ZenPkgs and:
- Apps are contractually required to comply with CyviZen approach of 'Responsibility is Power' & 'You Own Your Own Data'
- Settlement in Cy is available for Apps that offer artefacts (dominion of man) physically or digitally
- CyviCo is under the authority of CyviZen and is bound to CyviZen
- CyviCo entities are bound to international & local legal framework
Authority / Jurisdiction / Legislature
- CyviZen is a MultiNational Not-For-Profit established for mutual benefit in provision of (prototype) technology, data ownership, property registration and similar intent of enabling (prototype) technology to communities and their members as codified into CyviZen foundational paperwork:
- for clarity CyviZen -> CTC -> DeniZen, reflects the relationship, CyviZen claims no direct members
- at CyviZen discretion it may establish subsidiaries for purpose of supporting CTC or CyviCo as MultiNational extensions of the parent CyviZen. Such subsidiaries are duty bound to parent foundational paperwork
- CyviZen intends to comply with moral principles codified in Cyberspace, International Legislation and local legal frameworks

Liability
- CyviZen is not liable for individual, entity; use, abuse or misuse of its technology, bundled isolated or otherwise. It is the responsibility of DeniZen or Entity to verify compliance with legislative jurisdicture, whether based in contract, tort or legal theory.
- The DeniZen, CTC, or CyviCo Partner holds CyviZen harmless against all third-party claims and expenses arising against them concerning CyviZen technology
- The CTC is responsible for selecting a shipping method suitable for their needs.
- Some Shipping agents per their terms & conditions are unable to ship to residential addresses
- CyviZen ships via standard haulage terms of Shipping agents, Insurance or Extras Cover et al is not included.
- Should the DeniZen, CTC or CyviCo Partner require Shipping Insurance or Extras Cover, they are responsible for organising such insurance via a suitable Insurance Broker for their situation.
- For clarity, CyviZen is not liable for any lost, damaged, or delayed items during shipping.
- DeniZen directly or indirectly using CyviZen technology recognise
- is unique and custom-made for use by an Enthusiast/Specialist/Professional
- uses cryptographic and prototype technologies and techniques as part of its operational requirements
- is unable to operate without access to bundled cryptographic and prototype technology
- CyviZen uniquely fingerprints every JUBU L33T and any shell it is permanently installed on
- DeniZen hold CyviZen harmless against all third-party claims and expenses arising concerning CyviZen technology
Updates / Vulnerabilities / Upgrades
- Updates and/or upgrades might result in sense &/or apps being replaced or removed from availability within CyviZen due to emergent situations such as termination of open source status; abandonment of development; safety concerns; incompatibility with CyviZen ecosystem et al. CyviZen will endeavour to provide alternatives where available within the open source community.
- CyviZen bundles a list of Common Vulnerability Executions (CVEs) as identified against https://nvd.nist.gov/ into its technology within documentation available
- there is no obligation to use applications that contain CVEs, DeniZen make their own risk determination
- CVEs are outside of CyviZens control, as identified against their respective Open Source project, and said projects should be consulted or assisted in addressing patches for removal of CVEs affecting said projects
Warranty
- Vendors to CyviZen take sufficient steps as required by their industry to ensure their technology is provided of the highest quality and free from known defects at the time of manufacture
- CyviZen verifies sanitization and functional installation on JUBU L33T prior to shipping
- JUBU DL33T attracts a 1 year return to factory warranty
- JUBU L33T attracts a 1 year return to factory warranty
- Claims per warranty must be initiated by the DeniZen via umatter.cyvizen.art
Returns
- CyviZens JUBU L33T is uniquely customised per unit and is not eligible for a refund.
- CyviZen is not responsible for shipping of products.

- The latest version of these terms is always available on www.cyvizen.art and will be updated at this location; no additional notifications will be issued.
