Legislature

• CyviZen is a global Not-For-Profit as codified into the constitutional documents of parent and subsidiaries;
• CyviZen intends to comply with the moral principles that are codified in Cyberspace, International Legislation and local laws;

• CyvZen brings awareness of CyberSpace, supportive and/or supplemental technologies to Enthusiasts/Specialists/Professionals
• Financials, donated, raised, or accumulated by CyviZen from any means are prioritised for
  • CyberSpace awareness to Enthusiasts/Specialists/Professionals
  • Direct and/or indirect Research & Development of
    • CyberSpace linked technologies
    • Emergency digital communications
    • Digital safety of Enthusiasts/Specialists/Professionals
  • Payment of Licenses, Intellectual Property, grants, royalties et al
  • Incubative environments in alignment with "Reconcile Technology to Mankind"
• CyviZen distributes its technology as both software & hardware to international entities (Channel Partners) whom may be not-for-profit, governmental, B2B or B2C.

Entanglement

• CyviZen only sells technology to Channel Partners whom are verified by way of:
  • Intending to onsell JUBU L33T at the Recommended Retail Price of SYD$133.70
  • Able to fulfil the minimum order required of 10 JUBU L33T units per month for a minimum term of 6 months
  • Selling CyviZen products as close to the Recommended Retail Price as practically possible.
  • Having an account on www.cyvizen.art is required for any purchase and is considered an application to be a Channel Partner
• CyviZen maintains a public record of Channel Partners and ability to contact them at www.cyvizen.art/channel-partners . Channel Partners may opt-out of this list by notifying CyviZen in writing.
• CyviZen provides support and/or discussion only with enthusiasts/specialists/professionals as verified by way of:
  • Breaking the From Enthusiast To Enthusiast (FETE) seal on JUBU L33T retail box
  • and/or modifying CyviZen as installed on JUBU L33T in any capacity. (i.e. partially completing the initial setup process)

Access

• CyviZen and any item of any kind associated via cyvizen.art is the exclusive licensed property of CyviZen.
  • Said items are not available for public use under any license, this includes logos, trade secrets, and any upstream licenses utilised by CyviZen for the provision of technology
  • Channel Partners are permitted to quote & rephrase content published on www.cyvizen.art, news.cyvizen.art on any medium with copyleft attribution.
  • Enthusiasts/Specialists/Professionals are permitted to share their experience on any platform provided such experience is not derogatory, scandalous or defamatory to CyviZen or other Enthusiasts/Specialists/Professionals
• CyviZen documentation bundled into the Operating System is not permitted to be shared with any who are not Enthusiasts/Specialists/Professionals
• CyviZen technology may contain and utilise prototype technology of additional benefit to enthusiasts/specialists/professionals
• CyviZen reserves the right without obligation to terminate the provision of technology to any Channel Partner for any reason with a full refund of unshipped orders and an offer to repurchase outstanding stock at the current wholesale price less the cost of shipping.

Liability

• CyviZen is not liable for individual, entity; use, abuse or misuse of its technology, bundled isolated or otherwise. It is the responsibility of said users to verify compliance with legislative jurisdicture, whether based in contract, tort or legal theory.
• The Channel Partner holds CyviZen harmless against all third-party claims and expenses arising against them concerning CyviZen technology
• The Channel Partner is responsible for selecting a shipping method suitable for their needs.
  • Some Shipping agents per their terms & conditions are unable to ship to residential addresses
  • CyviZen ships via standard haulage terms of Shipping agents, Insurance or Extras Cover et al is not included.
  • Should the Channel Partner require Shipping Insurance or Extras Cover, they are responsible for organising such insurance via a suitable Insurance Broker for their situation.
  • For clarity, CyviZen is not liable for any lost, damaged, or delayed items during shipping.
• Enthusiasts/Specialists/Professionals directly or indirectly using CyviZen technology recognise
  • is unique and custom-made for use by an Enthusiast/Specialist/Professional
  • uses cryptographic and prototype technologies and techniques as part of its operational requirements
  • is unable to operate without access to bundled cryptographic and prototype technology
  • CyviZen uniquely fingerprints every JUBU L33T and any shell it is permanently installed on
• Enthusiasts/Specialists/Professionals hold CyviZen harmless against all third-party claims and expenses arising concerning CyviZen technology

Updates / Vulnerabilities / Upgrades

• Updates and/or upgrades might result in applications being replaced or removed from availability within CyviZen due to emergent situations such as termination of open source status; abandonment of development; safety concerns; incompatibility with CyviZen ecosystem et al. CyviZen will endeavour to provide alternative applications where available within the open source community.
• CyviZen bundles a list of Common Vulnerability Executions (CVEs) as identified against https://nvd.nist.gov/ into its technology within documentation available
  • there is no obligation to use applications that contain CVEs, Enthusiasts/Specialists/Professionals make their own risk determination
  • CVEs are outside of CyviZens control, as identified against their respective Open Source project, and said projects should be consulted or assisted in addressing patches for removal of CVEs affecting said projects

Warranty

• Vendors to CyviZen take sufficient steps as required by their industry to ensure their technology is provided of the highest quality and free from known defects at the time of shipping
• CyviZen verifies sanitization and functional installation on JUBU L33T prior to shipping
• JUBU L33T attracts a 1 year return to factory warranty
• Apricon devices attract a 3 year return to factory warranty
• OnlyKey does not provide a warranty
• Claims per warranty must be initiated by the enthusiast/specialist/professional via umatter.cyvizen.art

Returns

• CyviZen's JUBU L33T is uniquely customised per unit and is not eligible for a refund.
• CyviZen will replace stock damaged by shipping to Channel Partners where shipping insurance has been added to checkout. A claim must be filed with CyviZen within 24 hours of delivery receipt, accompanied by photos of the damage.
• CyviZen is not responsible for shipping of products from the Channel Partners to Businesses or Customers.

Revisions

• The latest version of these terms is always available on www.cyvizen.art and will be updated at this location; no additional notifications will be issued. Each order placed by a Channel Partner is considered an acceptance of the current version of the terms.
